18 U.S.C. § 2257 exemption statement

All visual depictions appearing on CrushNights are computer-generated. This website contains no photographs, video or audio of any actual human being.

The statement

The operator of CrushNights (“the Site”) states that the requirements of 18 U.S.C. § 2257, 18 U.S.C. § 2257A and 28 C.F.R. Part 75 do not apply to any content published on the Site.

Those provisions impose record-keeping and labelling obligations on producers of visual depictions of actual human beings engaged in actual or simulated sexually explicit conduct. No content on the Site is such a depiction, for two independent reasons, either of which is sufficient on its own.

No actual human beings are depicted

Every companion on the Site is a fictional character. Every photograph, every video frame and every voice recording attributed to a companion was produced by generative models operated by the Site. There are no performers, no models, no actors and no participants of any kind. Nobody was photographed, recorded or filmed in the making of this content, and no image on the Site is derived from a photograph of an identifiable person.

Because no human being appears in any depiction, there is no performer whose identification documents could be collected, and no producer relationship of the kind the statute regulates. The Site does not maintain performer records for the same reason a novel does not: there are no performers.

Each companion is presented as an adult. No companion is written, depicted or permitted to be portrayed as a minor, in any context, and the Site's conversational systems refuse such requests.

No sexually explicit conduct is depicted

Separately and additionally, the Site does not publish depictions of sexually explicit conduct as defined at 18 U.S.C. § 2256(2). Its published content ceiling is suggestive and non-explicit: companions appear clothed, in swimwear or in lingerie. The Site does not publish nudity, and it does not generate explicit sexual content in text, image, audio or video, at any price or on any account tier.

Age and access

The Site is intended solely for adults aged 18 or over, or the age of majority in the visitor's jurisdiction if higher. Access is gated on an affirmative statement of age before content is shown, and the Site is labelled for third-party filtering software.

User-submitted content

The Site does not accept, host or publish images, video or audio uploaded by users. There is no mechanism by which a visitor can publish a visual depiction to the Site, and consequently no third-party content to which record-keeping obligations could attach.

If you believe any content on this Site depicts a real person, resembles a real person, or was published without consent, report it and it will be reviewed and removed where warranted. Report content.
